Resumen El trabajo busca analizar el origen y contexto histórico-jurídico en el cual se concibió la teoría de las prohibiciones probatorias, inicialmente propuesta por el jurista alemán Ernst Beling. Asimismo, se expondrá la incidencia que dicha propuesta ha tenido en la doctrina y jurisprudencia chilena.
