          Abstract

          El presente trabajo tiene por finalidad abordar el equilibrio de las prestaciones contenidas en un contrato como una manifestación del imperativo de justicia conmutativa que se proyecta en diferentes momentos del iter contractual, proponiendo su construcción dogmática a partir de diversas normas contenidas en el Código Civil y demostrar cómo su formulación permite justificar entre nosotros la aplicación de ciertas instituciones introducidas por el moderno Derecho de las Obligaciones y Contratos, contribuyendo a fortalecer y consolidar esta tendencia dogmática que en los últimos años ha concitado el interés de un destacado sector de la doctrina nacional.

          Translated abstract

          The present work aims to address the equilibrium of benefits contained in a contract as a manifestation of the commutative justice imperative, which projects at different moments during the contractual procedure, proposing its dogmatic construction from various legal precepts contained in the Civil Code, and demonstrate how its formulation allows justify the application of certain institutions introduced by the modern law of obligations and contracts, thus contributing to strengthen that dogmatic tendency which, in recent years, has aroused the interest of a prominent sector of the national doctrine.
