          Abstract

          Resumen El presente artículo ofrece una exégesis de D. 12,1,4,1, texto en el cual Ulpiano reconoce al deudor pignoraticio la posibilidad de ejercer la condictio contra el acreedor que no restituye la cosa prendada, habiendo ya sido cumplida la obligación principal, o que percibe los frutos de la cosa sin una causa que lo justifique. Si bien la mayor parte de la doctrina ve aquí una referencia implícita al hurto (condictio ex causa furtiva), creemos que esta fuente, genuina en su sustancia, da cuenta de un supuesto de condictio sine datione no furtiva, en consonancia con la doctrina sabiniana de que se puede ejercer la condictio cada vez que alguien retiene una cosa en su poder ex iniusta causa.

          Translated abstract

          Abstract This article offers an exegesis of D. 12,1,4,1, a text in which Ulpian recognizes the pledgor the possibility of exercising the condictio against the pledgee who does not return the pledge or who receives its products without a cause that justifies it. Although most of the doctrine sees here an implicit reference to theft (condictio ex causa furtiva), we think that this source, genuine in its substance, attests a case of condictio sine datione non furtiva, in line with Sabinian doctrine that condictio can be exercised every time someone retains a thing ex iniusta causa.
