ASAMBLEA CONSTITUYENTE: LA EXPERIENCIA LATINOAMERICANA Y EL ACTUAL DEBATE EN CHILE Translated title: Constituent Assembly: The Latin American experience and the current debate in Chile

Abstract

La figura de la Asamblea Constituyente surge junto con el constitucionalismo y la democracia moderna en occidente. La generación de constituciones como consecuencia de un particular procedimiento de debate deliberativo hizo que la doctrina caracterizara de manera precisa dicha institución. La secuencia de procesos constituyentes generados en las últimas décadas en Latinoamérica es también expresión de la importancia que se atribuye a las Asambleas Constituyentes. Dichos procesos aspiran a conformar una suerte de nuevo constitucionalismo latinoamericano, que permita saldar una deuda histórica con los pueblos originarios y con los demás actores postergados de la reflexión constitucional. El impacto legitimador de estos procesos constituyentes y el empoderamiento constitucional de los movimientos sociales latinoamericanos influye también en otros Estados de la región. Uno de ellos es el caso de Chile donde, en los últimos años, se debate intensamente acerca de la Asamblea Constituyente como mecanismo para elaborar una nueva Carta Fundamental.

Thefigure ofthe constituent assembly emerges along with constitutionalism and modern democracy in the West. The doctrine has thoroughly developed such institution since a whole generation ofconstitutions was the product ofa particular process ofdeliberative debate. The sequence ofconstituent processes taking place in Latin America during the last decades evidences the importance ofConstituent Assemblies. Such processes aimed to form what has been called new Latin American constitutionalism, which would put an end to the historical debt towards the indigenous communities and other postponed agents from the constitutional debate. The legitimizing effect of those constituent processes and the constitutional empowerment ofthe Latin American social movements have influenced other States in the region. One of those is the Chilean case, where in the last years, there has been an intense debate about the Constitution Assembly as a mechanism for the creation ofa new Constitutional Charter.
